Eventus 50/50 Club — Official Terms and Conditions
Last updated: November 4, 2026
These Terms and Conditions (the "Program Terms") govern the Eventus 50/50 Club (the "Program") offered by Eventus Labs, Inc., a Delaware corporation ("Eventus," "we," "us"). By submitting a Rebate Claim, you agree to these Program Terms and to the Eventus Terms of Service. If they conflict, these Program Terms control for the Program only.
1. Program overview. During the Program Period, eligible organizers who sell tickets to an eligible event through the Eventus app may request a rebate equal to fifty percent (50%) of the Net Eventus Revenue earned on that event, up to the Maximum Rebate, by submitting a Rebate Claim after the event. Rebates are issued as Eventus Credits unless you elect cash, as described in Section 8.
2. Program Period. The Program begins at 12:00 a.m. Pacific Time on November 4, 2026 and continues until the end date Eventus sets under Section 12, or until Eventus ends the Program under Section 12 (the "Program Period"). Only events that take place within the Program Period are eligible, subject to Section 12.
3. Eligible organizers. To participate you must: (a) be either an individual at least 18 years old or a legally formed business entity; (b) be located in the United States; (c) hold an Eventus organizer account in good standing (at the time of the event, at the time of your claim, and at the time any rebate is issued); and (d) not be an employee, officer, director, contractor or agent of Eventus, or an immediate family or household member of one; and (e) provide, before any cash rebate is paid, a completed IRS Form W-9 and any other tax or payout information, in each case if Eventus requests it or if required by law. Eventus may verify eligibility at any time, including by screening against applicable sanctions lists.
4. Eligible events. An event is eligible only if it: (a) is published on Eventus on or after [START DATE]; (b) sells tickets through Eventus's native ticketing and checkout; (c) takes place in person or online on the published date, substantially as described (or, if rescheduled, on a rescheduled date within the Program Period that is published on Eventus); (d) sells paid tickets to at least five (5) different purchasers, none of whom is the organizer or an affiliate, employee, agent, or family or household member of the organizer ; and (e) complies with the Eventus Terms of Service and all applicable laws. Free events, RSVP-only events, events ticketed off-platform, and events hosted or co-hosted by Eventus are not eligible. For purposes of the Program, an "event" is a single occurrence on a single date or, for a continuous multi-day event sold under one ticket, a single occurrence. Eventus may treat events that appear to have been divided or structured primarily to multiply rebates as one event. Regularly scheduled recurring events, such as a weekly class or a monthly party, are separate events and are not treated as divided or structured to multiply rebates.
5. Rebate amount and Maximum Rebate.
(a) "Net Eventus Revenue" means the service and ticketing fees paid by ticket buyers that Eventus actually receives and retains on paid tickets to an eligible event, less Stripe and other payment processing fees, refunds, chargebacks, disputes, discounts, promotional credits and any taxes included in the amounts collected . Ticket face value paid out to the organizer is not Eventus revenue. Eventus calculates Net Eventus Revenue from its own records, and that calculation controls. On request, Eventus will provide a summary of how it calculated Net Eventus Revenue for a claim.
(b) The rebate equals 50% of Net Eventus Revenue for each eligible event, rounded down to the nearest cent.
(c) The rebate for any one eligible event may not exceed $1,000.00 (the "Maximum Rebate"). There is no limit on the number of eligible events for which an organizer may claim a rebate.
(d) Each eligible event earns no more than one rebate. Co-hosted events earn one rebate, paid to the primary organizer of record.
6. How to claim. To receive a rebate you must submit a complete Rebate Claim through the form at www.eventusapp.com/5050clubform no earlier than the day after the event and no later than 11:59 p.m. Pacific Time on the 30th day after the event ends (an event ends at the scheduled end time of its final session as published on Eventus) (the "Claim Deadline"). Each claim must include your Eventus account email, the event name and date, your payout election, and any information Eventus reasonably requests. Late, incomplete or duplicate claims will not be accepted. You are responsible for submitting your claim; Eventus will not issue rebates automatically.
7. Review. Eventus will review claims and may request supporting information, such as attendance records, check-in data or photos. Eventus may deny a claim it reasonably believes does not meet these Program Terms. Organizers may submit claims for any number of eligible events, subject to the Maximum Rebate. Eventus will use reasonable efforts to approve or deny each complete claim within [45] days after receiving it and will state the reason if a claim is denied.
8. Payment. Approved rebates are issued no sooner than 30 days after the event ends, and no later than [30] days after the later of that date and the date your claim is approved. Unless you elect cash on the claim form, your rebate is issued as Eventus Credits in your organizer account equal to 120% of the rebate amount (for example, a $100 rebate is issued as $120 in Eventus Credits). If you elect cash, Eventus pays 100% of the rebate amount to your payout account on file, subject to Section 3(e). Eventus Credits may only be used for Eventus products and services such as event Boosts, have no cash value, are not transferable. Eventus Credits are forfeited if your account is closed or terminated for cause and are otherwise subject to the Eventus Terms of Service. Your payout election for a claim is final once the rebate is issued.
9. Adjustments and clawback. If, after a rebate is issued, any ticket on the event is refunded, charged back or reversed, or Eventus determines the claim did not meet these Program Terms, Eventus may recalculate the rebate and recover any excess (for rebates issued as Eventus Credits, the corresponding credit amount or, to the extent those credits have already been used, the rebate amount in cash) by deducting it from future payouts or credits, or by invoicing you, payable within 30 days. This right continues after the Claim Deadline and after the Program ends.
10. Fraud and abuse. Eventus may disqualify any organizer, deny or reverse any rebate, and suspend the related account if it reasonably believes the organizer has: purchased or arranged the purchase of tickets to inflate revenue (including with Eventus Credits or other funds provided by the organizer or its affiliates); claimed for fictitious or cancelled events; claimed more than one rebate for the same event; split or structured events to multiply rebates; submitted false information; or otherwise acted in bad faith.
11. Taxes. You are responsible for any taxes on rebates you receive. Eventus will issue tax forms where required by law. Eventus may withhold taxes from any rebate (including backup withholding) where required by law, and you authorize Eventus to report rebates, including the value of Eventus Credits where Eventus determines reporting is required, to taxing authorities. Eventus may request a completed IRS Form W-9 from any organizer whose rebates, including Eventus Credits, may be reportable, and may hold any rebate until it is received. Eventus makes no representation about the tax treatment of any rebate.
12. Expiration, changes and termination. Eventus may, at any time and in its sole discretion: (a) set or change an end date for the Program; (b) limit eligibility to First-Time Organizers; (c) otherwise modify these Program Terms; or (d) suspend or end the Program. Eventus will give notice by posting in the app or on eventusapp.com and by email to organizers with a published eligible event or a pending claim, and the change takes effect 14 days after posting unless the notice states a later date (the "Effective Date"). A "First-Time Organizer" is an organizer that, before the Effective Date of such a change, has not sold paid tickets through Eventus and has not received a rebate under the Program, as determined by Eventus. Changes do not reduce rebates for eligible events that were published on Eventus before the Effective Date and take place on or before [the date that is 90 days after the Effective Date], provided their claims are submitted by the Claim Deadline.
13. No other obligations. Participation does not create any partnership, agency, employment or joint venture between you and Eventus. Rebates are not wages.
14. Limitation of liability. To the fullest extent permitted by law, Eventus's total liability arising from the Program is limited to the amount of the rebate, if any, owed to you under these Program Terms, and Eventus is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or revenue, arising from the Program. Nothing in this Section limits liability that cannot be limited under applicable law.
15. Governing law and disputes. These Program Terms are governed by the laws of the State of [California], without regard to conflict-of-laws rules. Disputes are resolved under the dispute resolution provisions of the Eventus Terms of Service.
16. Void where prohibited. The Program is void where prohibited or restricted by law.
17. Contact. Questions about the Program can be sent to [SUPPORT EMAIL].
18. General. You may not assign these Program Terms or transfer any rebate or Eventus Credits without Eventus's written consent; Eventus may assign them. If any provision is held unenforceable, the rest remain in effect, and Eventus's failure to enforce a provision is not a waiver. These Program Terms and the Eventus Terms of Service are the entire agreement between you and Eventus regarding the Program. Notices to you may be sent to your Eventus account email. Eventus will handle information you submit under the Program in accordance with the Eventus Privacy Policy.
